Next, the employer must approach both
the injured worker and the WCB case manager
and advise that they are prepared to
accommodate the injured worker in whatever
physical restrictions there are. This
needs to be done in writing and preferably
– in the case of the injured worker – in person,
or at least by telephone and then in
writing as a follow up.
Now the negotiations will begin, and at
times there will be pushback from one or all
parties. This can be a very stressful time indeed,
not just for the employer, but also for
the injured worker. It can be beneficial to
hire a third party to be in the middle of this
conflict to keep a cool head and keep emotions
out of play to ensure a smooth transition
while the injured worker transitions
back to the workplace.
Labour Standards Canada and the
Saskatchewan WCB Act both mandate
that employers must accommodate injured
workers whenever possible, with few exceptions.
The WCB Act mandates that the
WCB, injured workers and care providers
must cooperate with a return to work program
when possible, as well. If everyone
does their part, the program should run
smoothly and efficiently.
